Will Bank of America see a sealed misdemeanor charge?
I was arrested in 2004 for a misdemeanor retail theft charge. I was young and dumb and acted on peer pressure even though I knew it was wrong. I had the charge sealed off my record. I am now in the process of interviewing with Bank of America for a personal banker position and was wondering what to do? Will they see it? And should I disclose it to the recruiter as soon as possible?
I read that they do a background check using your fingerprints through the FBI
If the charge has been sealed (exponged, locked, removed, whatever you wanna call it), then they cannot see it, and you have no legal obligation to tell them about it, nor do they have the legal right to ask about any charges that have been removed, sealed, etc... If they ask about it, politely inform them that it is not relavant to the position you're applying for, and move onto the next question. If they hassle you about it, politely explain to them that they you have no legal obligation to disclose that information, nor do they have the legal right to ask for that information.
Also, it's a misdemeanor. Most of the time, when they do background checks, etc... such as this, they're looking for felonies on your record, and rarely take misdemeanors into consideration, even if it hasn't been sealed. Best of luck at your interview!
